Federal Judge Orders Release of Kilmar Abrego Garcia from Immigration Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to answer human smuggling charges, he was held in immigration custody.
In her decision, the judge noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The legal proceedings center on disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
